Licensing and Disclosures

This page contains the licensing and regulatory disclosures for Metuka, Inc. (“Metuka,” “we,” “us,” or “our”) and for the Metuka service available at metuka.ai (the “Service”). We publish it so that consumers, mortgage professionals, and regulators can see, in one place and in plain English, what Metuka is, what it is not, and who is responsible for the licensed mortgage activity connected with the Service. Please read it together with our Terms of Service, Privacy Policy, SMS and Messaging Terms, and Consent to Electronic Communications.

1. Who Metuka Is, and Who It Is Not

Metuka, Inc. is a software company. The Service is a business-to-business software product sold to independent mortgage brokers and licensed loan officers (our “Customers”). In this page, we call the licensed professional or brokerage responsible for a given loan the “Mortgage Professional,” the same term used in our SMS and Messaging Terms. The Service provides an AI assistant, Metuka, that performs the administrative labor that surrounds a mortgage file: organizing loan status and documents, reading and verifying paperwork such as paystubs, W-2s, bank statements, and tax returns, tracking underwriting conditions, drafting and sending status communications, answering questions, and helping coordinate the parties to a closing.

Metuka, Inc. is not a lender, a mortgage broker, a mortgage banker, or a loan officer. Metuka does not make loans, does not arrange or negotiate loans, does not take residential mortgage loan applications, does not offer or negotiate the terms of a residential mortgage loan, and does not hold itself out as doing any of those things. Specifically, Metuka does not:

  • quote, price, set, or lock interest rates or loan terms;
  • approve or deny any applicant, or prequalify any borrower;
  • make any credit or underwriting decision, score applicants, or serve as the basis for any credit decision;
  • issue legal disclosures required in a mortgage transaction;
  • collect fees from consumers, service loans, or extend credit of any kind.

If you are a borrower or a real estate agent who receives communications through the Service, you are a client of your Mortgage Professional, not a client of Metuka, Inc. Your loan, your application, and your relationship of record are with your Mortgage Professional and with the lender that funds the loan.

2. Licensing Status of Metuka, Inc.

Metuka, Inc. does not hold a mortgage license and is not licensed or registered under the Secure and Fair Enforcement for Mortgage Licensing Act (the SAFE Act) or under any state mortgage licensing law. This is not an oversight. Licensing requirements attach to activities such as taking residential mortgage loan applications and offering or negotiating the terms of a residential mortgage loan, and Metuka performs none of them. The administrative and clerical support functions the Service performs are carried out at the direction of, and subject to the supervision and instruction of, the licensed professional responsible for each loan, consistent with the treatment of clerical and support duties under the SAFE Act and Regulation H. Every activity that requires a license is performed by a licensed human professional or a lender, as described in Section 3.

Because Metuka, Inc. is not a licensee, it does not appear in the Nationwide Multistate Licensing System and Registry (NMLS) as a mortgage company. The Mortgage Professionals who use the Service do appear there, and you can look them up at any time through NMLS Consumer Access, the free public database operated on behalf of state financial regulators.

3. The Role of Licensed Professionals

Every licensed act connected with a loan file handled through the Service is performed by a licensed human professional or the lender responsible for that loan. Each Mortgage Professional is the responsible party of record for the loans they originate and is responsible for holding the licenses required in the states where they act. The Service itself is developed and operated under the supervision of a licensed loan officer, NMLS #1184022; for loans that the supervising loan officer originates through the Service, the supervising loan officer performs every licensed act on those loans and is their responsible party of record. On every loan file:

  • Pricing and rate locks. Only the licensed professional responsible for the loan prices the loan or locks a rate. The AI assistant may prepare a file for that moment; it is not permitted to take the action.
  • Approvals and denials. Only a licensed human decides whether an application moves forward. Underwriting decisions are made by the wholesale lender, not by Metuka and not by the AI assistant.
  • Legal disclosures. Required mortgage disclosures are issued by the licensed professional or the lender responsible for the loan, never by the AI assistant on its own authority.

These are not policies layered on top of the product; they are built into it. The Service is built so that the AI assistant is not permitted to take a licensed act: each licensed act is a hard stop that requires a recorded action by the responsible licensed professional before anything proceeds. In addition, every outbound message to a borrower or real estate agent passes an automated compliance check before it is sent.

You can verify the license, licensing history, and authorized states of any mortgage loan originator, including the supervising loan officer, at NMLS Consumer Access by searching NMLS #1184022.

4. AI Transparency

Metuka is an artificial intelligence assistant, and we say so. When you interact with Metuka, whether by chat, email, or text message, you are interacting with software supervised by a licensed human professional. Metuka is identified as an AI assistant and does not pretend to be a human being.

  • A licensed human stays in charge. A licensed professional reviews and personally performs every licensed act, as described in Section 3. The AI assistant handles administrative work; decisions about your loan are made by licensed humans and by the lender.
  • You can always ask for a person. You may ask to speak with your Mortgage Professional at any time, in any conversation, and the Service routes those requests to your Mortgage Professional promptly. Metuka never deprioritizes a file because someone asked for a human.
  • Messages are checked before they go out. Every borrower-facing and agent-facing message passes an automated compliance review before it is sent.
  • Your information is not used to train AI models. Metuka does not train or fine-tune foundation models and does not use consumers’ nonpublic personal information to train AI models. Our Privacy Policy explains how we handle information.

5. Where the Service Is Available

Mortgage services are offered by licensed professionals and lenders, not by Metuka, Inc. Licensed professionals using the Service may offer mortgage services only in states where they hold the license required for the activity in question, and each Mortgage Professional is responsible for complying with the licensing laws of the states where they act. Nothing on this site is an offer to provide mortgage services in any state. State-by-state licensing information for any NMLS licensee is available through NMLS Consumer Access.

6. Equal Housing Opportunity

Equal Housing Opportunity. The mortgage services connected with the Service are provided in accordance with the federal Fair Housing Act. It is illegal to discriminate against any person in the terms, conditions, or availability of a residential mortgage loan because of race, color, religion, national origin, sex, disability, or familial status. The Mortgage Professionals and lenders involved in loans touched by the Service are required to comply with the Fair Housing Act and all applicable fair housing laws, and Metuka builds its software to support that compliance.

7. Fair Lending and Credit Decisions

The Service is designed so that the AI assistant does not make credit or underwriting decisions. The AI assistant does not approve or deny applicants, does not score applicants, does not recommend approval or denial, is not designed to recommend loan products or terms, and is not used as the basis for any credit decision. Its document processing and condition tracking are administrative inputs that are reviewed and acted on by licensed professionals and lenders, who alone make credit decisions. Questions about loan products, rates, or terms are referred to the licensed professional responsible for the loan. Credit decisions are subject to the Equal Credit Opportunity Act (ECOA), Regulation B, the Fair Housing Act, and all other applicable fair lending laws, which prohibit discrimination on the basis of race, color, religion, national origin, sex, marital status, age, receipt of public assistance income, or the good faith exercise of rights under the Consumer Credit Protection Act.

If you believe you have experienced discrimination in connection with a loan, or if you have a concern about how the Service handled your file, we want to hear about it. You may contact us at legal@metuka.ai, and you may also raise fair lending concerns directly with the Consumer Financial Protection Bureau at consumerfinance.gov or the U.S. Department of Housing and Urban Development at hud.gov. Metuka will not retaliate against anyone for raising a concern.

8. Advertising Disclaimers

Nothing on this website, and nothing produced by the Service, is a commitment to lend, a loan approval, a prequalification, or an offer to extend credit. All loans are subject to a completed application, credit approval, underwriting, and program guidelines. Rates, terms, program availability, and eligibility requirements are set by lenders and licensed professionals, change without notice, and are not published, quoted, or promised by Metuka, Inc.

To avoid any misunderstanding about our marketing:

  • Metuka, Inc. is not affiliated with, endorsed by, or acting on behalf of any government agency, and the Service is not a government program.
  • We make no representation about the interest rate, payment, loan terms, or amount of credit any consumer will receive, or about the likelihood that any application will be approved.
  • Where this site describes speed, volume, availability, or savings, those descriptions explain how the product is designed to work; individual results vary.
  • Any statement about rates, loan programs, or loan terms that reaches a consumer through the Service comes from the licensed professional or lender responsible for the loan, not from Metuka, Inc.

9. Verifying a License or Filing a Complaint

To verify the license of any mortgage loan originator or mortgage company, including your Mortgage Professional or the supervising loan officer (NMLS #1184022), visit NMLS Consumer Access. It is free, operated on behalf of state financial regulators, and shows each licensee’s current licenses, employment history, and any public regulatory actions. NMLS Consumer Access also provides information on how to contact the state regulator that oversees a licensee if you wish to file a complaint about licensed mortgage activity.

Complaints or questions about Metuka, Inc. or the Service itself should be directed to legal@metuka.ai. Complaints are reviewed and, where they concern licensed mortgage activity, routed to the licensed professional responsible for the loan as the responsible party of record.

This page is provided for information and transparency. It is not a contract, a commitment, or an offer, and it does not create rights in any third party. Use of the Service, and any dispute with Metuka, Inc., is governed by our Terms of Service, including its dispute resolution and arbitration provisions (administered by the American Arbitration Association and seated in Maricopa County, Arizona) and its Arizona governing law clause.

Our Customers are independent licensed businesses and professionals. Each is solely responsible for its own licensing, disclosures, conduct, and compliance with applicable law, and Metuka, Inc. does not supervise, control, or assume responsibility for their licensed activities.
